Muscle Memory is an iPhone app operated by me, Ruaridh Bell, a sole trader based in Scotland. In these terms, “I”, “me” and “my” refer to Ruaridh Bell. By downloading or using Muscle Memory you agree to these terms. If you don’t agree with them, please don’t use the app.
I grant you a personal, non-transferable, revocable licence to use Muscle Memory on Apple devices that you own or control, as permitted by the App Store Terms of Service. You may not copy, redistribute, sell or rent the app, reverse-engineer it, or use it to build a competing product. This licence ends automatically if you break these terms.
You need an account to use Muscle Memory, created with Sign in with Apple. You must be at least 13 years old. You are responsible for what happens under your account and for keeping your Apple ID secure. One account per person, and your username must not impersonate someone else.
Your workouts, photos, comments and profile stay yours. By posting them you give me permission to store them and show them to the people your privacy settings allow, for as long as they’re in the app. Delete something and that permission ends.
There is no tolerance for objectionable content or abusive users. Don’t post anything that is illegal, hateful, harassing, sexually explicit, violent, or that you don’t have the right to share, and don’t post photos of other people without their permission. Every workout, comment and profile can be reported from the app. I review reports within 24 hours and will remove content that breaks these terms and suspend or close the accounts responsible, without notice where it’s serious.
Muscle Memory is a training log. Its stats, estimated one-rep maxes, heart-rate zones and streak reminders are for information and motivation, not medical or professional advice. Lifting carries a risk of injury: train within your limits, use proper form and spotters, and speak to a doctor before starting a new programme if you have any health concerns.
Muscle Memory is free to use. Muscle Memory Pro is optional and unlocks unlimited routines, saving friends’ workouts as routines, full chart history, body measurements beyond height, more photos per workout, and the plate calculator.
A streak repair is a one-off in-app purchase that restores a single broken week of your training streak. It is used up as soon as it’s applied, and your first repair is free. Streaks and repairs have no cash value and can’t be transferred.
Purchases go through Apple, so refunds are handled by Apple under their terms and I cannot issue them directly. You can request one at reportaproblem.apple.com. This does not affect your legal rights as a consumer, including any statutory cancellation rights.
I will do my best to keep Muscle Memory running and your training history safe, but I can’t promise it will always be available or error-free. I may change, suspend or discontinue features, including Pro features. If I withdraw something significant that you have paid for, get in touch and I’ll sort out a fair resolution.
Don’t use Muscle Memory to break the law, don’t try to reach parts of the service or other people’s data you aren’t entitled to, don’t spam, scrape or bulk-download from it, and don’t interfere with its operation or with other users. Automated access to the API from outside the app is not permitted.
Nothing in these terms limits my liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law. Your statutory rights as a consumer, including under the Consumer Rights Act 2015, are not affected.
Subject to that, Muscle Memory is provided “as is”. I am not liable for indirect or consequential loss, loss of data, or loss of profit. Where I am liable, my total liability is limited to the amount you paid for Muscle Memory in the twelve months before the claim arose.
These terms are between you and me, not Apple. Apple is not responsible for Muscle Memory or its content and has no obligation to provide support for it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation.
I may update these terms. The date at the top shows the last change, and I’ll flag anything significant in the app. Continuing to use Muscle Memory after a change means you accept it.
These terms are governed by the law of Scotland, and disputes will be subject to the jurisdiction of the Scottish courts. If you are a consumer resident elsewhere, you keep the protection of the mandatory consumer laws of the country you live in, and may bring proceedings in your local courts.
